9 (Planning) Days of Christmas

In advance of the Christmas season it is useful to note that for planning deadlines (other than in relation to Development Plan, Local Area Plan, etc. timeframes), the ‘clock’ stops between 24th December and 1st January each year, in accordance with Section 251 of the Planning and Development Acts, 2000-2017, which states: “Where calculating any appropriate period or other time limit referred to in this Act or in any regulations made under this Act, the period between the 24th day of December and the first day of January, both days inclusive, shall be disregarded.”
Also, where the last day for making an appeal, referral, etc. to An Bord Pleanála falls on a Saturday, Sunday, public holiday or other day on which the Board are closed, the submission will be regarded as valid if it is received on the next day the Board’s offices are open.
